1. Acceptance of Terms

By accessing or using the facilities, programs, or services offered by Pickle Athletics, whether in person or online (including bookings made via PlayByPoint), you agree to be bound by these Terms of Service, our Privacy Policy, and the Liability Waiver (collectively, the “Agreement”). If you do not agree, you may not access or use our services.

 

2. Eligibility

You must be at least 16 years old to participate in activities unless an event is specifically designated as a youth event or over 21+ event. Exceptions to the age policy may be made at the sole discretion of management with prior written approval.

 

3. Membership and Access

We offer a variety of access options including:

  • Drop-in sessions
  • Guest passes
  • Annual memberships
  • Access to courts, classes, leagues, and special events is subject to availability and applicable fees.
  • All bookings must be made via our third-party platform, PlayByPoint, through our app or website.

 

4. Booking, Cancellations, and Refunds

  • Members and guests may book sessions and services via our app or website (using PlayByPoint third party technology system)
  • Cancellations: Bookings must be canceled at least 24 hours in advance to receive a full refund or credit.
  • Late cancellations or no-shows may result in forfeiture of fees or incur penalties at our discretion.
  • For clinics, leagues, and private events, custom cancellation terms may apply and will be posted at the time of booking.

 

5. Code of Conduct

A. Purpose and General Obligation

This Code of Conduct establishes expectations for behavior to ensure a safe, respectful, welcoming, and enjoyable environment for all members, guests, and staff at Pickle Athletics. Adherence to this Code is a condition of membership. All members and their guests agree to abide by this Code at all times while at the Club or participating in off-site Club-sanctioned or sponsored events.

B. Respect for Others

All participants shall:

  • Treat all individuals with courtesy, dignity, and respect, regardless of skill level, age, background, gender, sexuality, ethnicity, or any other characteristic.
  • Refrain from harassment, discrimination, intimidation, bullying, threats, or abuse.
  • Avoid profane, offensive, or abusive language or gestures.
  • Maintain control over temper and emotions; no shouting (except for game calls), throwing equipment, or aggressive behavior.
  • Promote an inclusive atmosphere.
 
C. Sportsmanship and Fair Play
  • All participants shall:
  • Abide by USA Pickleball rules unless otherwise specified.
  • Demonstrate good sportsmanship and fairness.
  • Play safely and call “Ball on court!” if needed.
D. Respect for Facility and Rules

All participants shall:

  • Comply with all posted rules and regulations.
  • Wear appropriate non-marking court shoes and athletic attire with complete top and bottoms.
  • Treat property with care and report any damage.
  • Keep spaces clean and remove belongings after play.
  • Enter/exit courts respectfully.
  • Follow staff instructions at all times.
  • No alcohol or illegal substances unless expressly permitted; never play while impaired.
  • Playing music without headphones or using amplification tools is not permitted.
E. Enforcement
  • Members are responsible for their guests.
  • Management may address any detrimental conduct.
  • Disciplinary actions may include warnings, suspensions, or termination without refund.
  • Members should report violations promptly and respectfully.
F. Acknowledgment

By signing this Agreement, participants acknowledge they have read, understood, and agree to this Code of Conduct and to ensure their guests comply. Failure to adhere may result in disciplinary action.

6. Facility Use and Safety

  • All participants must have a signed liability waiver on file before engaging in any activities.
  • Use of the facility is at your own risk. You are responsible for your personal belongings.
  • Security cameras may be in use for safety and loss prevention.
  • In case of emergency, please follow all evacuation and staff instructions.

 

7. Programs, Clinics, Leagues, and Private Events

  • Offerings include open play, private and group lessons, leagues, tournaments, and community events.
  • Each event or program may be subject to its own pricing, eligibility, registration deadlines, and rules.
  • All participants must agree to the applicable terms and policies before enrolling.

 

8. Waiver and Release of Liability

  • Participation in Pickle Athletics activities involves physical exertion and risk of injury. By using our services, you:
  • Acknowledge the risks of participation
  • Agree to assume all responsibility for injury or loss
  • Release and hold harmless Pickle Athletics, its staff, owners, and affiliates from any claims or damages arising from your participation

9. Privacy and Data Collection

  • We use third-party platforms (including PlayByPoint) for scheduling, communication, and payments. These platforms may collect personal and payment information subject to their own privacy policies.
  • We do not sell or rent your personal data. By using our services, you consent to our collection and use of your information for club operations, analytics, and communications.
  • For media captured on site (photos or videos), we reserve the right to use such content for promotional purposes unless you opt out in writing.

 

10. Intellectual Property

All content, branding, and materials associated with Pickle Athletics—including our name, logo, and original programming—are the property of Pickle Athletics and may not be used without written consent.

11. Dispute Resolution

You agree that any disputes arising out of or related to your use of our services shall be resolved:

  • First through informal negotiations with management.
  • If unresolved, then through binding arbitration in accordance with the rules of the American Arbitration Association.
  • The Agreement shall be governed by the laws of the State of California, without regard to conflict of law principles.

 

12. Modifications to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website or app. Continued use of our services after such changes constitutes your acceptance.

 

13. Force Majeure

We are not liable for any failure or delay in performance due to events beyond our control, including natural disasters, facility damage, pandemics, labor disputes, governmental orders, or similar events.
